一、指导思想

以“三个代表”重要思想和党的十六大、十六届三中、四中全会精神为指导,贯彻依法治国的方针,集中时间,突出重点。打防结合,标本兼治,充分发挥基层党政组织和群众组织的作用,动员全社会的力量,加强综合治理,落实工作责任,力争通过专项行动扭转当前我县赌博违法犯罪活动比较突出的局面,净化社会环境,促进社会主义精神文明建设,全力维护我县社会治安稳定。

二、工作目标

打掉一批赌博团伙、窝点,铲除、封堵一批赌博网站,查破一批大案要案,依法惩处严重的赌博违法犯罪人员。有效遏制网络赌博、六合彩等非法彩票等赌博活动蔓延的势头;坚决取缔境外赌博(博彩)公司、赌博网站在境内设立的代理机构、赌博网点;严肃查处党政领导干部、国家公职人员、国有企事业单位负责人参赌的问题;切实堵住我县公民到我周边国家境外赌场参赌的渠道。建立打击赌博违法犯罪活动工作长效机制,形成广大人民群众自觉抵制赌博活动的社会氛围。

三、工作重点

(一)打击的重点对象

l、赌博网站的开办者、经营者、维护者;

2、非法彩票等赌博活动的组织者;

3、赌场开设者、聚众赌博的组织者;

4、参与赌博的党政领导干部、国家公职人员、国有企事业单位负责人;

5、娱乐服务场所内利用游戏机等各种方式赌博的组织者或业主。

(二)整治的重点地区

1、聚众赌博问题突出的乡、镇;

2、非法彩票赌博问题突出,聚众赌博问题严重的乡、镇;

3、娱乐服务场所利用游戏机等各种方式赌博严重的地方。

四、工作措施

(一)加大办案力度,依法惩处一批赌博违法犯罪分子。

公安局、检察院、法院要充分发挥各自的职能作用,共同挂牌督办一批赌博违法犯罪大案要案。县公安局要认真研究部署,精心组织安排,制定工作方案,狠抓措施落实,集中优势兵力,迅速对赌博活动形成围剿态势,清除其滋生的土壤。要认真开展线索排查,深挖案件线索。对治安情况复杂的村组,要集中警力进行排查,要把在历次严打中处理过的、有赌博劣迹的重点人员纳入视线,发挥特情耳目的作用,注意发现赌博违法犯罪活动的苗头和线索,发现一批有价值的涉赌案件线索,选准突破口,收集、固定相关证据,及时抓捕犯罪嫌疑人,努力破获一批大案要案。对于重大、复杂、疑难的案件,公安局要及时商请检察院、法院提前介入。检察院要按照依法从重从快的方针和“基本事实清楚、基本证据确实、充分”的原则,及时批捕,提起公诉。法院要及时依法审判,从严惩处一批违法犯罪分子。

(二)严厉打击网络赌博活动,铲除、封堵赌博网站。

坚决铲除境内的赌博网站,封堵境外的赌博网站,端掉一批网络赌博窝点,依法从严惩处一批违法犯罪人员。对于赌博信息要坚决予以删除和关闭。有效截断向赌博网站账户转移资金的渠道。对设置赌博型电子游戏机,或者明知开设赌博网站组织赌博,明知上网人员从事赌博活动仍为其提供上网服务的,要依法查处。

(三)严厉打击非法彩票等赌博活动,规范合法彩票的发行和销售。对未经国家批准擅自发行彩票,或以有奖销售、有奖竟猜为名非法发行或变相发行彩票的赌博活动,要坚决依法予以打击,从严惩处非法彩票赌博活动的组织者和提供条件者;对彩票机构违规擅自更改彩票规则,或对外承包、转包彩票发行及销售职责的,要依法追究彩票机构主要负责人及相关责任人的责任,构成犯罪的依法追究刑事责任;对赌球等具有赌博性质的博彩活动,要按照赌博行为依法查处。

(四)加大对旅店业、娱乐服务场所的监管力度,严厉打击其中的赌博活动。严格按照国务院《娱乐场所管理条例》等法律法规要求,采取有力措施,强化对旅店业和歌舞娱乐、网吧等娱乐服务场所的监督管理。

(五)严肃查处党政领导干部、国家公职人员、国有企事业单位负责人参与赌博的违法犯罪行为。依照《中国共产党纪律处分条例》和中央纪委、中央组织部《关于严肃查处党员和干部参与赌博的通知》(组通字43号)等规定,凡是参与赌博的领导干部,要一律予以免职,对到境外赌博的要从严惩处;对利用贪污、挪用公款等犯罪所得款物赌博的,要从重处罚,同时构成赌博罪的,要数罪并罚;对利用赌博活动索贿、受贿、行贿的,要从重处罚。

(六)加强对企业、个人资金流动状况的监管。禁止境内居民使用银行卡、通过银行账户向境外赌博网站账户支付赌金,最大限度地阻断赌博资金流通渠道。严厉打击和取缔地下钱庄的非法活动。建立赌博网站账户黑名单制度,防范不法分子利用银行支付结算平台从事赌博等非法支付业务。

(七)加强出入境管理,严厉打击出境赌博活动。加强对出入边境人员审核,防止我县公民出境参赌。加强对出境人员携带现金的监管,严格按照规定的标准验放,对违规携带大量现金出境的行为要依法查处。依法严格境外旅游证件的审批、签发工作,对到我周边国家境外赌场从业的我县公民,不予核发出境证,已发出的予以收回。

(八)加强综合治理,建立打击赌博违法犯罪活动长效机制。通过开展专项行动,建立健全赌博违法犯罪活动信息通报机制,查处、打击赌博违法犯罪的工作机制,切断赌博活动“资金流”、“信息流”的防控机制和人民群众广泛参与的社会监督机制,从源头上铲除赌博活动赖以生存的基础。要以这次专项行动为契机,积极探索禁赌工作办法,建立长效管理机制,把管理责任真正落实到各部门、单位、乡镇(街道)、村(居)委会、社区,使其真正成为禁赌工作的前沿堡垒,规划方案《组织开展集中打击赌博违法犯罪活动专项行动工作方案》。要针对当前赌博活动中的新情况、新问题,正确运用有关法律法规和司法解释,依法打击赌博违法犯罪活动。

五、职责分工

公安机关:及时发现和查证赌博活动线索,依法严厉打击赌博违法犯罪活动;加强对互联网信息服务、接入服务单位、网吧等互联网上网服务营业场所和旅店业、公共场所的安全监管,落实防控措施。对发现、查处的党政领导干部、国家公职人员、国有企事业单位负责人要及时通报纪检、监察、组织部门。

检察机关:做好对赌博犯罪案件的批捕、起诉和诉讼监督,及时纠正在专项行动工作中出现的有案不立、有罪不究、以罚代刑、重罪轻判等问题。坚决依法查办与赌博犯罪活动相关的职务犯罪案件。

人民法院:加快涉及赌博犯罪案件的审判工作进度,依法加大罚金、没收财产等财产刑的适用力度,彻底剥夺犯罪分子的非法获利和再次犯罪资本。纪检监察机关:严肃查处为赌博活动提供保护和干扰、阻挠打击赌博违法犯罪活动工作,以及参与赌博的党员领导干部、国家公职人员、国有企事业单位负责人。

组织部门:严格要求、严格教育、严格管理、严格监督党员干部,努力提高广大党员干部思想政治修养,自觉同赌博违法犯罪行为作坚决斗争。对参与赌博的领导干部,按照干部管理权限提出免职建议或意见。对充当保护伞的党政领导干部,采取党纪、政纪措施,严禁说情打招呼。

宣传部门:组织宣传国家有关禁赌的法律、法规,赌博活动的危害,开展打击赌博违法犯罪活动工作的重要意义和取得的成果,营造良好的舆论氛围。

电信主管部门:组织开展境内网站清理整顿,落实网站审批、备案制度,对发现境内互联网接入服务单位、互联网数据中心开设赌博网站或明知是赌博网站仍为赌博网站提供服务的,要严肃查处,直至取消其经营资格。对专门为境外赌场提供电信服务的,要坚决撤除有关设施。积极配合公安机关查证赌博线索,关闭、封堵赌博网站。对故意为赌博活动提供声讯、视频、短信服务的运营商要严肃查处。银行监管部门:加强行业监管,督促银行业金融机构建立健全有关制度,采取有效措施,限制和切断赌博资金支付、流通渠道。对明知赌场、赌博网站利用银行交易平台从事非法支付活动而仍然提供服务、提供条件或放任不管的金融机构及工作人员,要严肃查处。积极配合公安机关开展调查取证工作。

旅游管理部门:加强行业监管,进一步整顿和规范旅游秩序,对诱导和组织游客到旅游场所参赌的,一律取消其经营资格。文化部门:加强对网吧等互联网上网服务营业场所和文化娱乐场所经营活动的管理,严禁被利用从事赌博违法犯罪活动。

教育部门:加强对在校学生的教育,积极引导在校学生养成良好的行为习惯,远离赌博活动。

工商行政管理部门:严格对宾馆饭店、娱乐服务场所的注册登记,监管工作,规范其经营行为,依法查处无照经营、违法经营的场所和非法有奖销售活动。

财政部门:不断完善合法彩票的管理政策,引导彩民购买合法彩票,通过市场挤压非法彩票赌博违法犯罪的活动空间。严格监管彩票机构和彩票市场,严厉查处彩票机构的违规行为,确保彩票市场平稳健康发展。按照国家“分级管理,分级负担”的管理体制以及现行经费开支渠道等有关规定,保障开展专项行动中应由财政负担的、必需的工作经费。

综治部门:结合当前开展的“平安创建”和基层安全创建活动,发挥基层党政组织和基层群众组织的作用,广泛发动群众,积极开展不让赌博进社区、进乡村等形式多样的活动,形成全社会共同参与专项行动的良好局面。

共青团委、工会、妇联:在广大共青团员、职工、妇女和家庭中,积极开展禁赌宣传教育活动,增强预防和禁赌意识,培养良好的行为习惯,积极参与打击赌博违法犯罪专项斗争,深入开展不让赌博活动进入厂矿企业、单位和家庭的活动,发动共青团员、职工、妇女积极检举揭发赌博团伙、窝点及有赌博恶习的人。

六、工作要求

(一)提高认识,加强领导。

各乡镇和各部门要充分认识赌博违法犯罪活动的严重性和危害性,切实增强开展专项行动的责任感和紧迫感,把思想统一到中央领导同志的重要批示精神上来,把行动统一到专项行动的部署和要求上来,把打击赌博违法犯罪活动作为促进先进文化发展、维护最广大人民群众根本利益的一项重要举措,下大力气抓紧抓好,切实抓出成效。为了确保专项整治工作扎实有效,县上成立由县政府分管领导担任组长,公安局、宣传部等部门为成员的全县集中打击赌博违法犯罪活动专项行动工作协调小组,负责专项行动的组织协调工作。各乡镇也要相应成立协调小组,负责本辖区专项行动的组织协调工作。专项行动分动员部署、调查摸底(1月11日—1月31日),集中整治、严厉打击(2月—4月),总结深化、建章立制(5月1日—5月底)三个阶段进行。

(二)密切配合,落实责任。

各乡镇党委、政府按照职责分工,积极开展工作。公安局、检察院、法院、纪检监察部门、组织部,要充分发挥职能作用,严肃查处赌博违法犯罪活动。电信、银监等主管部门要落实各项监管措施,督促从业单位开展清理整顿和自查自纠活动。其他各有关部门要积极参与,各司其职,各负其责。各部门要加强协同配合,形成工作合力。

(三)加大宣传力度,广泛发动群众。

通过多种形式,大张旗鼓地宣传国家有关打击赌博违法犯罪活动的法律法规,讲清政策界限,讲明赌博的法律后果。通过以案释法,宣传赌博活动的危害和开展专项行动的重要意义。公安局要公布举报电话,建立举报奖励制度;对积极提供线索,协助查破赌博大案要案的群众,要给与奖励。要充分调动群众检举揭发赌博活动的积极性,增强群众抵制赌博恶习的自觉性和与赌博活动作斗争的主动性,形成全民支持、参与专项行动的良好舆论氛围。

(四)把握政策界限,突出打击重点。

正确区分赌博行为和群众娱乐活动。对不以营利为目的,带有少量输赢的打麻将、玩扑克等娱乐活动,不以赌博论处;对参与赌博活动情节轻微、赌资数额较小的,予以批评教育;对为赌博话动提供网络服务、场所等条件或提供保护的,依法查处;对开设赌场、聚众赌博、非法发行彩票、开设经营赌博网站的,要坚决追究刑事责任,严禁降格处理,以罚代刑。

(五)加强检查指导,严肃工作纪律。

县专项行动工作协调领导小组将对专项行动开展情况适时进行督导、检查。对工作扎实、成效显著的乡镇、单位和个人,要予以表彰和奖励。对专项行动重视不够、组织不力,行动迟缓、工作措施不落实的,要予以通报批评。对丧失原则,为赌博违法犯罪分子通风报信或充当“保护伞”的,要依纪依法从严处理;对执法不严、放纵犯罪的,要严肃追究办案人员及其主管领导的责任;构成犯罪的,坚决追究其刑事责任。

(六)建立长效机制,巩固专项整治成果。

三、注重集中宣传与稽核相结合,确保基金安全长效运转。

It is a serious condition which affects the gambler but everyone he contacts with like family members, children’s, friends and relatives. Following are the some harmful effects of gambling: Financial Problem: Gambling directly attack on the finance of gambler who get addicted. Gambler needs more money to gamble, firstly he use his own money and think he is control. But in future he gets more addictive and borrows money from friends and other persons; the debt comes out of control. He/she may steal money to gamble. If the gambler gets arrested, he may acquire fine of get jail. Job loss: Lack of focus on other important task or work which are important in life because of gambling. Problem gambling costs society billions annually. The social costs of gambling addictions will eventually impact careers, physical and mental health issues, bankruptcy, divorce, crimes, and treatment. The gamblers will eventually rely on welfare or unemployment benefits, impacting the government, and the costs could reach several billions of dollars per year. 3. Gambling exploits the poor. Evidence shows that legalized gambling often hurts and even destroys, especially those who are poor and disadvantaged. If gambling were illegal, the gambling venues would not be able to promote their lotteries, casinos, or other forms of betting and exploit people who are most vulnerable. 4. Gambling sets a double standard for governments. Lotteries are agreeably an effective way to raise taxes. Legalized gambling is a disturbing governmental policy. Governments should promote desirable qualities in the citizens and not seduce them to gamble in state-sponsored vice. When this occurs, the government contributes to the corruption of society. Legalized gambling is a bad social policy. At a time when independent organizations estimate that there are at least 12 million compulsive gamblers, it does not make a lot of sense to have the state promoting gambling.
